Diesel Fuel Regulations (Proposed)
Notice is hereby given, pursuant to subsection 48(1) of the Canadian Environmental Protection Act*, that the Governor in Council, pursuant to sections 47** and 87 of that Act, proposes to make the annexed Diesel Fuel Regulations.
Any person may, pursuant to subsection 48(2) of the Canadian Environmental Protection Act*, file a notice of objection concerning the proposed Regulations with the Minister of the Environment within 60 days after the date of publication of this notice, requesting that a board of review be established under section 89 of that Act and stating the reasons for the objection. All such notices of objection must cite the Canada Gazette, Part I and the date of publication of this notice and be sent to the Director, Transportation Systems Branch, Air Pollution Prevention Directorate, Environmental Protection Service, Department of the Environment, Ottawa, Ontario KIA OH3.

DIESEL FUEL REGULATIONS
INTERPRETATION
1. The definitions in this section apply in these Regulations.
"Act" means the Canadian Environmental Protection Act.
(Loi)
"diesel fuel" means petroleum fuel that can be evaporated at atmospheric pressure, that boils within the range of 150 degrees C to 400 degrees C and that is for use in diesel engines. (carburant diesel)
"heavy-duty vehicle" has the same meaning as in Schedule V to the Motor Vehicle Safety Regulations. (vehicule lourd)
"light-duty truck" has the same meaning as in Schedule V to the Motor Vehicle Safety Regulations. (camionnette)
"light-duty vehicle" has the same meaning as in Schedule V to the Motor Vehicle Safety Regulations. (vehicule leger)
MAXIMUM CONCENTRATION OF SULPHUR
2. For the purposes of section 46 of the Act, where diesel fuel is for use in light-duty vehicles, light-duty trucks and heavy-duty vehicles, the maximum concentration of sulphur is 0.05% of the fuel by weight.
ANALYSIS
3. The concentration of sulphur in diesel fuel referred to in section 2 shall be measured in accordance with the National Standard of Canada CAN/CGSB-3.0 No. 16.0-95, Methods of Testing Petroleum and Associated Products, Sulphur in Diesel Fuel by Energy Dispersive X-Ray Fluorescence Spectrometry (EDXRF), as amended from time to time.
REPORT
4. (1) Every person who produces or imports diesel fuel for use or sale in Canada shall submit to the Minister for each calendar quarter during which diesel fuel is produced or imported, within thirty days after the last day of each quarter, a report containing the information set out in the schedule.
(2) For the purposes of subsection (1), the information relating to the concentration of sulphur set out in the schedule shall be calculated using
(a) the standard test method referred to in section 3;
(b) ASTM D 5453, Standard Test Method for Determination of Total Sulfur in Light Hydrocarbons, Motor Fuels and Oils by Ultraviolet Fluorescence;
(c) ASTM D 2622, Standard Test Method for Sulfur in Petroleum Products by X-Ray Spectrometry; or
(d) ASTM D 1266, Standard Test Method for Sulfur in Petroleum Products (Lamp Method).
(3) Each report shall be signed
(a) in the case of a corporation, by an officer of the corporation authorized to do so; and
(b) in any other case, by the person submitting the report or a person authorized to act on behalf of that person.
RECORDS
5. (1) Every person who produces or imports diesel fuel for use or sale in Canada or sells or offers for sale diesel fuel shall keep a record of the quantities of diesel fuel that are produced, imported or sold for use in light-duty vehicles, light-duty trucks and heavy-duty vehicles.
(2) A record referred to in subsection (1) shall be maintained in Canada, at the point of production or retail sale or place of business of the importer, for a period of five years after the record is made.
COMING INTO FORCE
6. These Regulations come into force on October 1, 1997.
