ANALYSIS STATEMENT
Description

The Laurentian Pilotage Authority is a Federal Government corporation established pursuant to the Pilotage Act, R.S., 1985, c. P-14, and the objects of the Authority, in accordance with section 18 of the Act, are to develop, operate, maintain and administer, in the interests of safety, an efficient pilotage service in the Province of Quebec.


Pursuant to paragraph 33(1)(e) of the Act, an Authority shall, with the approval of the Governor in Council, make regulations prescribing tariffs of pilotage charges to be paid to that Authority for pilotage, and may fix tariffs of pilotage charges for the use of a pilot boat These amendments to the Laurentian Pilotage Authority Pilot Boat Tariff Regulations, 1997 are expected to become effective on January 1, 1997.


Alternatives

The Pilotage Authority owns and operates its own pilot boats at Les Escoumins, which is the first pilot boarding station for ships arriving from the Gulf of St. Lawrence. Private contractors operate the pilot boats at the other boarding stations.


The pilot boat charge at Les Escoumins is based on the projected number of services during a given year and the yearly costs of providing the service. The 1997 traffic forecast projects an increase in traffic over 1996, and since most costs are fixed costs, the charge per service will decrease in 1997 over 1996.


Section 34 of the Pilotage Act requires that pilotage charges for all pilot boat services at boarding stations, be published in the Canada Gazette.


Benefits and Costs

The pilotage charge for pilot boat services operated by the Authority at Les Escoumins represents the actual costs of operating the boats. The charge at Les Escoumins will decrease by 3.1 percent. At Quebec, the regular charges will increase by 5.5 percent and by .6 percent in respect of tug operators in the winter. At Trois-Rivieres, the increase is 2 percent, while at Sorel, Lanoraie and the port of Montreal, there is no increase. The Authority adds 4.8 percent to the operator's charge to cover its own

administration, i.e., invoicing, collecting the charges from the users, bookkeeping and paying the operators.


Where services are provided by contractors, the charges are those stipulated in the contracts with various contractors and accurately reflect the costs being incurred by the Authority in terms of contracts signed with the contractors to provide pilot boat services other than at Les Escoumins.


Consultation

By letter dated May 16, 1996, The Shipping Federation of Canada, Canadian Shipowners Association and St. Lawrence Shipoperators Association Inc., were asked to provide any comments they might have concerning these amendments, on or before, June 3, 1996. No comments were received. This is a new initiative and was not listed in the 1996 Federal Regulatory Plan.


Compliance and Enforcement

The Pilotage Act assures compliance and enforcement of the tariff regulations, and section 45 provides for the detention of ships when pilotage charges are outstanding and unpaid.

Notice is hereby given, pursuant to section 34* of the Pilotage Act, that the Laurentian Pilotage Authority, pursuant to section 33 of that Act, proposes to make the annexed Laurentian Pilotage Authority Pilot Boat Tariff Regulations, 1997.


Any interested person who has reason to believe that any charge in the proposed Regulations is prejudicial to the public interest, including the public interest that is consistent with the national transportation policy set out in section 5 of the Canada Transportation Act**, may file a notice of objection setting out the grounds therefor with the Canadian Transportation Agency within 30 days after the date of publication of this notice. The notice of objection should cite the Canada Gazette, Part I, and the date of publication of this notice, and be sent to the Canadian Transportation Agency, Ottawa, Ontario KIA ON9.

CHARGES FOR USE OF PILOT BOATS


1. (1) The charge for use of a pilot boat that departs from a pilot boarding station referred to in this subsection to embark, disembark or change pilots in respect of a ship, payable for any number of those services rendered in respect of the ship, is:

(a) at Les Escoumins - $345.00
(b) at Quebec,
(i) within the limits of the port, where subparagraph (iii) does not apply,
(A) effective January 1 to March 31 - 300.89
(B) effective April 1 to November 30 - 151.92
(C) effective December 1 to December 31 - 300.89
(ii) outside the limits of the port, where subpara
graph (iii) does not apply - 246.12
per hour, minimum 3 hours
(iii) where, because of ice conditions, the pilot boat used must be a tug,
(A) effective January I to April 7 - 901.28
(13) effective April 8 to December 6 - 450.64
(C) effective December 7 to December 31 - 901.28

(a) in the Pointe-aux-Trembles area
(i) effective January I to April 8 - $137.52
(ii) effective April 9 to November 30 - 56.90
(iii) effective December 1 to December 31 - 137.52
(b) in the Montreal-Est/Longue-Pointe area
(i) effective January 1 to April 8 - 203.92
(ii) effective April 9 to November 30 - 90.10
(iii) effective December 1 to December 31 - 203.92
(c) in the Vickers area and west of that area
